(Effective until May 18, 2013) Disposition of funds.

(a) Any fees required by this division shall be remitted to the department and, after the cost appropriation in subsection (c), shall be deposited to the credit of the state 21st Century Authority and then to the credit of the Recruitment and Training Promotion Fund for the purpose of funding a recruitment and training promotion program to be administered by the Alabama Construction Recruitment Institute.

(b) Fees collected pursuant to this division are appropriated to the Alabama 21st Century Authority to the credit of the Recruitment and Training Promotion Fund for each fiscal year, or part thereof, following May 18, 2009, and the proceeds from the fees shall be expended, in whole or in part, as deemed appropriate by the Alabama Construction Recruitment Institute and approved by the secretary or other designee of the Alabama 21st Century Authority.

(c) In addition to all other appropriations heretofore or hereinafter made, there is hereby appropriated to the department for the fiscal year ending September 30, 2009, such amount as is reasonably required to offset its administrative and collection costs as a first charge against the revenues from the fee levied by this division. For all subsequent fiscal years, there shall be appropriated to the department as a first charge against the revenues from the fee levied by this division an amount that will offset its actual costs in the administration and regulation of this fee.
