20-2313. Marketing practices A. An accountable health plan or its insurance producer shall not: 1. Discourage an employer from filing an application for a health benefits plan because of the health status-related factors, industry, occupation or geographic location of the employer. 2. Encourage or direct an employer to seek a health benefits plan from another insurer because of the health status-related factors, industry, occupation or geographic location of the employer. B. This section does not prohibit an accountable health plan from providing information regarding the geographic service area of the accountable health plan. C. Notwithstanding any law to the contrary, an accountable health plan may market health benefits plans to groups of small employers from the same or different industries that elect to pool their risks on a voluntary basis.
