32-2456. Authority to investigate complaint; filing; response; retention of records A. The department may investigate any licensee, registrant, associate, employee or person if that licensee, registrant, associate, employee or person is advertising as providing or is engaged in performing services that require licensure or registration under this chapter. B. The department shall investigate if a licensee or registrant is engaged in activities that do not comply with or are prohibited by this chapter. C. The department shall enforce this chapter without regard to the place or location in which a violation may have occurred. D. On the complaint of any person or on its own initiative, the department may investigate any suspected violation of this chapter or the business and business methods of any licensee, registrant or employee of a licensee or applicant for licensure or registration under this chapter. E. Complaints filed against any licensee, associate, registrant or employee of a licensee shall be in writing on such forms as the department prescribes and shall be filed with the department. F. In any investigation undertaken by the department, each licensee, associate, registrant, applicant, agency or employee, on request of the department, shall provide records and shall truthfully respond to questions concerning activities regulated under this chapter. These records shall be maintained for five years at the principal place of business of the licensee, or at another location for a person whose license has been terminated, cancelled or revoked. On request by the department during normal business hours or at another time acceptable to the parties, the records shall be made available immediately to the department unless the department determines that an extension may be granted. The licensee shall provide copies of any records requested by the department.
