32-3261. Credentialing committees; appointment; qualifications; terms; compensation; organization; immunity

A. The following credentialing committees are established:

1. Social work.

2. Counseling.

3. Marriage and family therapy.

4. Substance abuse counseling and treatment.

B. The governor shall appoint four professional members and one public member to each credentialing committee.

C. Each professional credentialing committee member shall:

1. Be a resident of this state for not less than one year before appointment.

2. Be an active licensee in good standing.

3. Have at least five years of experience in an area of behavioral health licensed pursuant to this chapter.

D. Each public member shall:

1. Be a resident of this state for not less than one year before appointment.

2. Be at least twenty-one years of age.

3. Not be or have ever been a behavioral health professional or the spouse of a behavioral health professional.

4. Not have or have ever had any financial interest in the provision of behavioral health services.

5. Not have engaged in any activity directly related to the practice of behavioral health.

E. The term of office of credentialing committee members is three years to begin and end on the third Monday in January. A member shall not serve more than two full consecutive terms.

F. Credentialing committee members are eligible to receive compensation as determined pursuant to section 38-611 for each day actually and necessarily spent in the performance of their duties.

G. A credentialing committee shall annually elect a chairman and secretary from its membership.

H. Credentialing committee members are personally immune from suit with respect to all acts done and actions taken in good faith and in furtherance of the purposes of this chapter.
