41-563.04. Treatment of non-lapsing appropriations A. For the purposes of this article and article IX, section 17, Constitution of Arizona, appropriations authorized and available for expenditure in prior fiscal years, to the extent they remain wholly or partially unexpended as of July 1, 1979 and that have been exempted from the provisions of section 35-190 shall be applied against the limitation of the first fiscal year during which expenditures were authorized by such appropriation and in no other fiscal year. B. For the purposes of this article and article IX, section 17, Constitution of Arizona, appropriated amounts authorized and available for expenditure in the current fiscal year or subsequent fiscal years and that are exempt from the provisions of section 35-190 shall be applied against the limitation only in the first fiscal year such amounts were authorized for expenditure and only to the extent such amounts have not been applied to the appropriations limitation of a prior fiscal year.
