41-769. Refusal of examination or certification The director may refuse to examine or, after examination, may refuse to certify as an eligible or may withdraw from certification anyone who: 1. Has practiced any deception or fraud in his application, in his examination or in securing his eligibility. 2. Has failed to reply within a reasonable time to communications concerning his availability for employment. 3. Is found to be unsuited or not qualified for employment. 4. Lacks any of the requirements established by the director for the examination or position for which he applies. 5. Is physically or mentally so disabled as to be rendered unfit to perform the duties of the position to which he seeks appointment.
