44-6901. Definitions In this chapter, unless the context otherwise requires: 1. "Copyright owner": (a) Means the owner of a copyright of a musical work that is recognized and enforceable pursuant to the copyright laws of the United States (P.L. 94-553; 17 United States Code sections 101 through 1101). (b) Does not include the owner of a copyright in a motion picture or audiovisual work or in any part of a motion picture or audiovisual work. 2. "Performing rights society" means any association, corporation or other entity that licenses the nondramatic public performance of musical works in this state on behalf of copyright owners, including the American society of composers, authors and publishers and broadcast music, inc. and SESAC, inc. 3. "Proprietor" means the owner of a retail establishment, restaurant, inn, bar, tavern, sports facility or entertainment facility or any other place of business, professional office or nonprofit organization facility that is located in this state, where the public may assemble and where musical works may be performed, broadcast or otherwise transmitted in a nondramatic manner for the enjoyment of the assembled public. 4. "Repertoire" means the copyrighted musical works licensed on behalf of the copyright owners by a performing rights society and available for nondramatic public performances. 5. "Royalty" means the fee payable by a proprietor to a performing rights society for the nondramatic public performance of musical works.
