§ 12-12-1002 - Penalties.
12-12-1002. Penalties.
(a) Upon conviction, any criminal justice agency or official subject to fingerprinting or reporting requirements under this subchapter that knowingly fails to comply with such reporting requirements is guilty of a Class B misdemeanor.
(b) (1) Upon conviction, any person who knowingly releases or discloses to any unauthorized person any information collected and maintained under this subchapter and any person who knowingly obtains information collected and maintained under this subchapter for purposes not authorized by this subchapter is guilty of a Class D felony.
(2) A person convicted for violating subdivision (b)(1) of this section is subject to an additional fine of not more than five hundred thousand dollars ($500,000).
