16-93-1502. Program eligibility.

(a) Offenders who have been found guilty of or pleaded guilty or nolo contendere to a violent offense as defined by 12-12-1103(11) [repealed] or a Class Y felony offense shall be ineligible to participate in the program established by this subchapter.

(b) As determined by the county sheriff, offenders who have committed violent or sexual acts while incarcerated in a county jail facility shall be ineligible to participate in the program established by this subchapter.
