12040. This article shall be known as the California State Government Wellness and Physical Fitness Act. 12041. The Legislature finds and declares that wellness and physical fitness should be the goal of every American and, therefore, creates the Council on Wellness and Physical Fitness with the following responsibilities: (a) Develop and coordinate state and local activities involving the wellness and physical fitness of all Californians, including workshops, clinics, conferences and other similar activities. (b) Assist schools in developing health and physical fitness programs which benefit students, including those with special needs. (c) Encourage local governments and communities to develop local wellness and physical fitness programs. (d) Enlist the support of individuals, civic groups, amateur and professional associations and other organizations to promote and improve wellness and physical fitness programs. (e) Assist business, industry, labor organizations, and state agencies in establishing sound wellness programs to improve employee health and reduce the costs resulting from physical inactivity. (f) Stimulate wellness and physical fitness research. (g) Give recognition to outstanding developments and achievements in, and contributions to, wellness and physical fitness. (h) Collect and disseminate wellness and physical fitness information, and initiate an advertising campaign promoting physical fitness and wellness. 12042. There is in the office of the Governor a Council on Wellness and Physical Fitness, hereinafter referred to as "council" which shall advocate and encourage wellness and physical fitness. (a) The council shall consist of 20 members, 10 to be appointed by the Governor, five by the Speaker of the Assembly, and five by the Senate Rules Committee for terms of four years and until the appointment and qualification of their successors. The members shall be broadly representative of the public and shall include members of the health, business, and education communities. In addition, the members shall be knowledgeable in the areas of health promotion, nutrition, physical fitness, and environmental sensitivity. (b) The council shall submit an annual report to the Legislature of its activities and shall include in this report its accomplishments. The first report of the office shall be submitted to the Legislature no later than January 15, 1984, and shall contain specific objectives developed by the council and means of accomplishing those objectives.
