Sec. 12-638a. Definitions.
Sec. 12-638a. Definitions. As used in this chapter, (1) "commissioner" means the
Commissioner of Revenue Services, and (2) "controlling interest" means (A) in the case
of a corporation, more than fifty per cent of the total combined voting power of all
classes of stock of such corporation, and (B) in the case of a partnership, association,
trust or other entity, more than fifty per cent of the capital, profits or beneficial interest
in such partnership, association, trust or other entity.

History: P.A. 89-251, S. 38 effective July 1, 1989, and applicable to sales or transfers of real property occurring on or
after that date; P.A. 90-315 amended the definition of controlling interest to mean in the case of a corporation "more than
50% of the total combined voting power of all classes of stock of such corporation" and including deletion of the alternative
"fifty per cent or more of the capital, profits or beneficial interest in the voting stock of such corporation" and in the case
of a partnership, association, trust or other entity "more than fifty per cent of the capital, profits or beneficial interest in
such entity", effective June 12, 1990, and applicable to any sale or transfer of a controlling interest in any entity occurring
on or after July 1, 1989.
