      Sec. 13b-390. (Formerly Sec. 16-284). Hearing on application for certificate. 
Upon the filing of an application and the payment of the fee prescribed, the Commissioner of Transportation shall, within a reasonable time, fix the time and place for a 
hearing thereon and shall promptly give written notice thereof to such parties in interest 
as the commissioner deems necessary and give public notice thereof at least one week 
prior to such hearing.

      History: 1969 act substituted "promptly give written notice" for "mail notice" and required notification of commissioner 
of transportation as well as parties in interest; P.A. 75-486 replaced public utilities commission with public utilities control 
authority; P.A. 77-614 replaced authority with division of public utility control within the department of business regulation, 
effective January 1, 1979; P.A. 80-482 made division of public utility control an independent department and deleted 
reference to abolished department of business regulation; P.A. 88-249 changed jurisdiction of motor carriers from the 
department of public utility control to the department of transportation effective July 1, 1989. (Revisor's note: Statute 
published in both Title 16 and Title 13b in the Connecticut General Statutes, Revision of 1958, revised to 1989; Sec. 16-284 transferred to Sec. 13b-390, effective July 1, 1989).

      Information secured by independent investigation apart from the hearing, and not made known upon the hearing, is not 
evidence properly in the case. Party before commission must have ample opportunity to examine exhibits, cross-examine
