Sec. 48-52. Requests to mediate eminent domain or relocation assistance disputes filed with Office of Ombudsman for Property Rights. Regulations. Motion
in Superior Court to stay related action. (a) The Ombudsman for Property Rights
shall adopt regulations, in accordance with chapter 54, to establish a mediation procedure
for requests to mediate eminent domain or relocation assistance disputes filed with the
Office of Ombudsman for Property Rights. Such regulations shall also establish criteria
to be used by the Ombudsman for Property Rights in determining whether to accept or
reject a request for mediation.
(b) If a request to mediate an eminent domain or relocation assistance dispute is
filed with the Ombudsman for Property Rights, pursuant to this section, any party to
the dispute may file a motion in the Superior Court to stay any related action during the
pendency of mediation under this section or the consideration of a request for such
mediation under this section. The court shall grant such motion for cause shown and
the order shall provide that the stay shall terminate upon motion of either party or, in
the event no motion is filed, on the earlier of: (1) The resolution of the dispute through
mediation; or (2) the earlier of (A) the expiration of any period for conducting mediation
pursuant to regulations adopted pursuant to subsection (a) of this section, or (B) a decision by the Ombudsman for Property Rights to deny a request for mediation.
