26.39 Penalty for nonattendance of judge.

Whenever such default shall occur, the clerk of the court (unless such judge shall file his or her reasons for such default as hereinbefore provided) shall certify the fact, under his or her official signature and seal, to the Chief Financial Officer of the state, who shall deduct from the warrants, thereafter to be issued in favor of the judge making such default, the sum of $100 as aforesaid for every such default.
