15-12-4. Ineligibility of juror to serve at next succeeding term


(a) Any juror who has served as a grand or trial juror at any session of the superior courts, state courts, or city courts shall be ineligible for duty as a juror at the next succeeding term of the court in which he has previously served. Nothing contained in this subsection shall prevent any trial juror from serving as a grand juror at the next term of the superior court of his county. This subsection shall not apply to any court in any county wherein the grand jury box contains not exceeding 100 names and the trial jury box contains not exceeding 350 names.

(b) When the name of any juror who is disqualified by subsection (a) of this Code section is drawn, the same shall not be recorded as a juror but shall be returned to the box from which it was drawn; and the drawing shall be continued until the jury is secured.
