53-2-4. (Pre-1998 Probate Code) Effect of partial illegality of will
If a will is legal in part and illegal in part, that part which is legal may be sustained unless the whole will so constitutes one testamentary scheme that the legal portion alone cannot give effect to the testator's intention; in such case the whole will shall fail.
