53-2-105. (Pre-1998 Probate Code) Ademption or destruction of legacy or devise


A legacy or devise is adeemed or destroyed, wholly or in part, when the testator delivers over the property or pays the money bequeathed to the legatee or devisee, either expressly or by implication, in lieu of the legacy or devise given, or when the testator conveys to another the specific property bequeathed and does not afterward become possessed of the same or otherwise places it out of the power of the executor to deliver over the legacy or devise. If the testator attempts to convey the property and fails for any cause, the legacy or devise is still valid.
