53-2-116. (Pre-1998 Probate Code) Compensatory devises or bequests to executors; precedence over other special gifts or bequests; effect on rights of creditors


Testators making wills in this state shall have the power of giving and bequeathing to the persons nominated as executors, as compensation for the services to be rendered by such executors in the execution of the trusts reposed in them, such property or money as the testators may bequeath or devise. All such gifts and bequests shall take precedence over any other special gifts or bequests made by testators; provided, however, that the gifts or bequests to executors shall not interfere with the rights of the creditors of the testators.
