53-3-16. (Pre-1998 Probate Code) Petition to probate nuncupative will -- Time of presentation of petition; contents and verification


(a) A petition to probate a nuncupative will shall be made before the court within six months after the death of the testator.

(b) The petition, in addition to other necessary averments, shall set forth the information required in a petition to probate a will in solemn form. The petition shall be verified and shall conclude with a prayer for the issuance of letters testamentary.
