53-3-49. (Pre-1998 Probate Code) Probate in this state prerequisite to management of property herein by executor or administrator; preservation of rights of foreign executors and administrators


Until a foreign will has been probated, as required in this article, no property in this state belonging to the testator shall be managed or controlled by the executor therein named or by any administrator with the will annexed who was appointed elsewhere. Nothing in this Code section shall impair the right of foreign executors and administrators to bring actions in the courts of this state, nor shall it impair their right to draw dividends, check out funds, or transfer stock, as provided by law.
