53-4-16. (Pre-1998 Probate Code) Effect of incapacity of heirs or devisees to hold title to real property
If the heirs of an intestate or the devisees of real property of a testator are incapable of holding title to real property, the judge of the probate court shall order the legal representative of the estate to sell the real property and pay over the proceeds to the devisees or heirs.
