53-6-25. (Pre-1998 Probate Code) Rules for granting letters of administration -- Preference for applicant offering security


Whenever, under a citation for administration according to Code Section 53-6-24, any person entitled to administration under the rules set forth in such Code section shall offer to the judge of the probate court good and sufficient security, as required in Code Section 53-7-30, even though he is not entitled to the administration by priority under the rules for granting letters, the person so offering security shall nevertheless be entitled to the administration, by reason of his ability to give security, in preference to one who has priority according to rule, but does not offer security.
