53-6-95. (Pre-1998 Probate Code) Administration of unrepresented estate by county administrator; citation; procedure when entire estate to be set aside as year's support


If, from any cause, an estate is unrepresented and not likely to be represented, the judge of the probate court shall vest the administration thereof in the county administrator, a citation being first published for four weeks, as in other cases. If, however, the estate does not exceed in value the sum exempted by law to the spouse and children of the decedent, no administration shall be necessary; but the judge of the probate court shall by order set apart the same to the spouse and children, as provided by law.
