53-7-36. (Pre-1998 Probate Code) Reduction of bond when value of estate decreased; effect on liability of surety for prior misconduct of fiduciary


(a) When it appears to the judge of the probate court that the value of an estate has decreased, he shall have the authority to permit a corresponding reduction in the amount of any bond required of any fiduciary.

(b) If the judge of the probate court permits a reduction in the amount of the bond, nothing contained in this Code section shall be construed to affect the liability of the surety for waste or misconduct by the fiduciary which might have occurred before the bond was reduced.
