53-7-45. (Pre-1998 Probate Code) Action on bond in first instance for failure to settle and account with distributee or legatee

When any executor or administrator fails to settle and account with any distributee or legatee of the estate he represents, the distributee or legatee may bring an action on the bond of the executor or administrator in the first instance and may recover judgment against the principal and his sureties without first bringing an action against the executor or administrator in his representative character.
