53-7-46. (Pre-1998 Probate Code) Actions upon bond against sureties in first instance

When any executor or administrator removes himself from this state, places himself in such a situation as by law would authorize an attachment against a debtor, or dies and his estate is unrepresented, any party in interest or any person having demands against that executor or administrator in his representative character may institute an action against the sureties or any one or more of them upon the bond of the executor or administrator in the first instance, without first obtaining a judgment against the executor or administrator in his representative character.
