    53-7-104.    (Pre-1998 Probate Code) Prosecution of claim by distributee  or creditor; distribution of proceeds by administrator or executor 
        If the administrator or executor, for any cause, shall decline to  litigate any claim, he may assign the claim to a distributee or  creditor, who may at his own expense prosecute the same.
