53-7-105. (Pre-1998 Probate Code) Compromise of claim in favor of estate when debtor delivers all property for use of creditors; order of probate court


An administrator or executor is authorized to compromise a claim in favor of the estate he represents when the debtor, in good faith, delivers all his property for the use of his creditors, except such property as is exempt from levy and sale in cases of insolvent debtors. However, the judge of the probate court, after an examination of the facts, shall first make an order directing the compromise.
