53-7-98. (Pre-1998 Probate Code) Actions to compel making of title according to terms of bond to make title or of contract for sale of land -- Application by heirs of deceased vendee for order making title to heirs; notice; payment of vendee's debts


If a vendee, having possession under a bond for title or under a contract for the purchase and sale of land or having paid the purchase money for land, dies, the judge of the probate court of the county having jurisdiction of the estate, upon a similar application by any one of the heirs at law of the vendee and on notice to the vendor, as provided in Code Section 53-7-97, may order the title to be made to the heirs at law of the decedent unless by the terms of a will the title should vest otherwise. The making of such a title, however, shall not prevent the lands from being assets in the hands of the administrator or executor of the vendee for the payment of debts.
