53-7-167. (Pre-1998 Probate Code) Action by heirs, distributees, or legatees against removed administrator or executor for settlement

If, upon the removal of an administrator or executor, no administrator de bonis non is appointed, or if the administrator de bonis non fails to bring the removed administrator or executor to account, the heirs at law or the distributees or legatees if there is a will, may bring an action directly for an accounting and settlement.
