53-7-189. (Pre-1998 Probate Code) Intermediate final reports -- Judgment surcharging fiduciary

Should it appear at the accounting that a fiduciary is liable to the trust or to any beneficiary or beneficiaries thereof, the judge of the probate court is authorized and it shall be his duty to enter a judgment surcharging the fiduciary in such amount as is authorized under the law and the evidence.
