53-8-21. (Pre-1998 Probate Code) Sale of perishable property; time and notice of sale; order of probate court; sales by temporary administrator


Perishable property, property that is liable to deteriorate from keeping, or property that is expensive to keep shall be sold as soon as practicable, consistent with the interest of the estate. The sale shall be made under order from the judge of the probate court. Such order shall specify the kind of notice and for what length of time, which shall not be less than ten days, it shall be given. The order for sale shall be granted as a matter of course unless the application is from a temporary administrator, in which case the judge may, in the exercise of his discretion, grant the order when it is made to appear to be to the interest and advantage of the estate.
