53-8-31. (Pre-1998 Probate Code) Livestock sales at public establishments; probate court order; accountability of administrator or executor


Administrators and executors are authorized to sell livestock at public sales establishments on sales days and during the regular hours of business of the sales establishments when the administrator or executor determines that the sale of the property is in the best interest of the estate. Good faith is required by the administrator or executor in all cases, and the livestock may be sold in such manner and quantities as he may deem most advantageous to the estate. The sales may be made at any time after an order authorizing the sale is obtained from the judge of the probate court, which order may be issued at any time after application therefor by the administrator or executor. The administrator or executor shall be accountable in all other respects as is otherwise provided by law.
