53-8-35. (Pre-1998 Probate Code) Private sale under will by administrator with will annexed; requirements for sale under will when mode of sale not specified


(a) If a will authorizes a private sale by the executor, an administrator with the will annexed may execute the power and sell the property without order from the judge of the probate court.

(b) If the will merely designates the property to be sold without specifying the mode of sale, no application for leave to sell shall be necessary; but in other respects, the executor or administrator with the will annexed shall comply with the requirements of law.
