53-8-41. (Pre-1998 Probate Code) Private conveyance of rights of way and easements to certain persons and entities -- Procedure at hearing; order

At the hearing, the judge of the probate court shall satisfy himself that service has been made as required by Code Section 53-8-40 and that the vendee is a proper one under Code Section 53-8-39 and shall, when so satisfied, pass an order reciting that proper service has been made, that the vendee is one of those specified in Code Section 53-8-39, and that the proposed conveyance has been approved, which order shall be final and conclusive.
