53-8-46. (Pre-1998 Probate Code) Authority to sell as prerequisite to divesting title of heir; effect of irregularities of sale


In order to divest the title of the heir at law, the administrator or, if applicable, the executor must receive authority to sell from the judge of the probate court. If there are irregularities in the sale or if he fails to comply with the law as to the mode of sale, the sale shall be voidable except as to innocent purchasers.
