    53-8-46.    (Pre-1998 Probate Code) Authority to sell as prerequisite to  divesting title of heir; effect of irregularities of sale 
        In order to divest the title of the heir at law, the administrator or,  if applicable, the executor must receive authority to sell from the  judge of the probate court.
