53-8-47. (Pre-1998 Probate Code) Extension of credit to purchaser; security; liability of administrator or executor


The administrator or the executor, where the will is silent on the subject, may exercise his discretion, except where otherwise provided, in demanding cash or extending credit. Full notice shall be given and the best interest of the estate observed. If credit is given, the administrator or executor shall, at his own risk, determine the sufficiency of the security given. If the security taken is ample at the time credit is extended and subsequently the debt is lost after the utmost diligence by the administrator or executor, he shall not be responsible for the amount.
