   53-8-70.    (Pre-1998 Probate Code) Claim to property proposed to be sold; filing and service of affidavit 
        When an executor, administrator, or other trustee advertises that it is  his intention to apply for leave to sell any property as the property  of his testator, intestate, or beneficiary or has obtained such order,  any person claiming the property may, either by himself, by his agent,  or by his attorney, file in the probate court an affidavit claiming the  property.
