   53-8-71.    (Pre-1998 Probate Code) Claim to real property; transmittal to superior court; venue; trial of issue 
        After an affidavit claiming real property has been made and filed and  notice has been given, as required in Code Section 53-8-70, it shall be  the duty of the judge of the probate court to transmit the claim  affidavit to the next term of the superior court of the county where the  land is located.
