53-8-72. (Pre-1998 Probate Code) Claims to personalty; transmittal to superior court; venue


When any executor, administrator, or other trustee advertises to sell any personal property of his testator, intestate, or beneficiary after the same is claimed on oath and the claim affidavit is filed and served as required in Code Section 53-8-70, it shall be the duty of the judge of the probate court to transmit the claim affidavit to the superior court next to be held after the claim is filed, in the county where the executor, administrator, or trustee resides.
