PROCEEDINGS IN MAGISTRATE’S DIVISION OF THE DISTRICT COURT
19-3939. Undertaking for appearance of witnesses. When notice of intention to appeal is given by the defendant as provided in the last section, the judge or justice may take from each of the material witnesses examined before him on the part of the people, a written undertaking, with or without sureties, to the effect that he will appear and testify in the district court upon the appeal, or that he will forfeit the sum of $500, as provided in case of commitment upon preliminary examination, or if the witness is unable to procure sureties he may be conditionally examined as there provided.
