Chapter 3. Expert Witnesses

Applicability of chapter
Sec. 1. This chapter applies to a witness who is an expert in any
art, science, trade, profession or mystery.

Witness compelled to appear and testify
Sec. 2. A witness described in section 1 of this chapter may be
compelled to appear and testify in:
(1) any court in the county of the residence of the witness; or
(2) any court in an adjoining county;
to an opinion as an expert in relation to any matter whenever the
opinion is material evidence relevant to an issue on trial before a
court or jury.

Per diem compensation and mileage
Sec. 3. A witness compelled to appear and testify under section 2
of this chapter may be compelled to do so without payment or tender
of compensation other than the per diem and mileage allowed by law
to other witnesses.

Expert witnesses subject to same rules as nonexpert witnesses
Sec. 4. The same rules and regulations apply to witnesses
described in section 1 of this chapter as apply to a witness who can
be compelled to appear and testify to knowledge the witness has of
facts relevant to the same issue.
