Chapter 4. Chauffeur's License

Issuance; conditions
Sec. 1. Except as otherwise provided in this article, the bureau
shall issue a chauffeur's license to an individual who meets the
following conditions:
(1) Satisfies the age requirements described in section 2 of this
chapter.
(2) Has operated a motor vehicle for more than one (1) year.
(3) Makes proper application to the bureau under IC 9-24-9
upon a form prescribed by the bureau.
(4) Satisfactorily passes the examination and tests required for
issuance of a chauffeur's license under IC 9-24-10.
(5) Pays the fee prescribed in IC 9-29-9.

Age requirement; hardship waiver
Sec. 2. (a) Except as provided in subsection (b), an individual
must be at least eighteen (18) years of age to receive a chauffeur's
license.
(b) The bureau may waive up to six (6) months of the age and
experience requirements for an individual making an application for
the individual's initial chauffeur's license due to hardship conditions.
(c) The bureau shall adopt rules under IC 4-22-2 to state the
conditions under which the age requirements may be waived.

Operator's license not required; surrender
Sec. 3. (a) An individual holding a valid chauffeur's license is not
required to obtain an operator's license.
(b) To receive a chauffeur's license, an individual must surrender
to the bureau any operator's license issued to the individual.

Operating privileges
Sec. 4. A chauffeur's license entitles the licensee to operate a
motor vehicle, except a motorcycle, upon a public highway. A
chauffeur's license does not entitle the licensee to operate a motor
vehicle as a public passenger chauffeur.

Employment of chauffeurs; license required
Sec. 5. A person may not employ another person as a chauffeur to
operate a motor vehicle unless the other person is licensed as
chauffeur under this chapter.

Chauffeur's licenseholder after June 30, 1991; term of operation
of commercial vehicle after issuance or renewal
Sec. 5.5. Notwithstanding any other law, a person holding a
chauffeur's license that is renewed or issued after June 30, 1991, is
not entitled by that license to operate a commercial motor vehicle for
more than thirty (30) days following the renewal or issuance.

Violations
Sec. 6. A person who violates this chapter commits a Class C
infraction.
