455B.433 PHYSICAL INFRASTRUCTURE ASSISTANCE -- FUNDING -- LIABILITY. 1. The department of natural resources shall work in conjunction with the Iowa department of economic development to identify environmentally contaminated sites which qualify for the infrastructure component of the grow Iowa values financial assistance program established in section 15G.112. The department shall provide an assessment of the site and shall provide any emergency response activities which the department deems necessary. The department may take any further action, including remediation of the site, that the department deems to be appropriate and which promotes the purposes of the infrastructure component. 2. The department shall be reimbursed from the grow Iowa values fund created in section 15G.111 for any costs incurred pursuant to this section. 3. A person shall not have standing pursuant to section 455B.111 to commence a citizen suit which is based upon property that is part of the infrastructure component of the grow Iowa values financial assistance program established in section 15G.112.          Section History: Recent Form 96 Acts, ch 1218, §53; 2009 Acts, ch 123, §32
