459.502 INDEMNITY FEES REQUIRED -- CONSTRUCTION PERMITS. An indemnity fee shall be assessed upon permittees which shall be paid to and collected by the department, prior to issuing a permit for the construction of a confinement feeding operation as provided in section 459.303. The amount of the fees shall be based on the following: 1. If the confinement feeding operation has an animal unit capacity of less than one thousand animal units, the following shall apply: a. For all animals other than poultry, the amount of the fee shall be ten cents per animal unit of capacity for confinement feeding operations. b. For poultry, the amount of the fee shall be four cents per animal unit of capacity for confinement feeding operations. 2. If the confinement feeding operation has an animal unit capacity of one thousand or more animal units but less than three thousand animal units, the following shall apply: a. For all animals other than poultry, the amount of the fee shall be fifteen cents per animal unit of capacity for confinement feeding operations. b. For poultry, the amount of the fee shall be six cents per animal unit of capacity for confinement feeding operations. 3. If the confinement feeding operation has an animal unit capacity of three thousand or more animal units, the following shall apply: a. For all animals other than poultry, the amount of the fee shall be twenty cents per animal unit of capacity for confinement feeding operations. b. For poultry, the amount of the fee shall be eight cents per animal unit of capacity for confinement feeding operations.
