222.65 INVESTIGATION.
If an application is made for placement of a person in a state
resource center or special unit, the administrator shall immediately
investigate the legal settlement of the person and proceed as
follows:
1. If the administrator concurs with a certified determination as
to legal settlement of the person so that the person is deemed a
state case, the administrator shall cause the person either to be
transferred to a resource center or a special unit or to be
transferred to the place of foreign settlement.
2. If the administrator disputes a certified determination of
legal settlement, the administrator shall order the person
transferred to a state resource center or a special unit until the
dispute is resolved.
3. If the administrator disputes a certified determination of
legal settlement, the administrator shall utilize the procedure
provided in section 225C.8 to resolve the dispute. A determination
of the person's legal settlement status made pursuant to section
225C.8 is conclusive. Section History: Early Form
