Chapter 21.--CRIMES AND PUNISHMENTS
PART II.--PROHIBITED CONDUCT
Article 38.--CRIMES AFFECTING GOVERNMENTAL FUNCTIONS

      21-3811.   Aiding escape.Aiding escape is:

      (a)   Assisting another who is in lawful custody on a charge or convictionof crime, on a charge or adjudication of a misdemeanor or felonyor on a commitment to the state security hospital as provided in K.S.A.22-3428and amendments thereto based on a finding that the person committed an actconstituting any crimeto escape from such custody; or

      (b)   supplying to another who is in lawful custody on a charge orconviction of crime, on a charge or adjudication of a misdemeanor or felonyor on a commitment to the state security hospital as provided in K.S.A.22-3428and amendments thereto based on a finding that the person committed an actconstituting any crime,any object or thing adapted or designed for use inmaking an escape, with intent that it shall be so used; or

      (c)   introducing into an institution in which a person is confined on acharge or conviction of crime, on a charge or adjudication of a misdemeanororfelony or into the state security hospital if suchperson is confined on a commitment to the state security hospital as providedin K.S.A. 22-3428 and amendments thereto based on a finding that the personcommitted an act constituting any crime any object or thing adapted ordesigned foruse in making any escape, with intent that it shall be so used.

      (d) (1)   Except as provided in paragraph (2),aiding escape is a severity level 8, nonperson felony.

      (2)   Aiding escape by an employee or volunteer of the department ofcorrections, or the employee or volunteer of a contractor who is under contractto provide services to the department of corrections, is a severity level 4,nonperson felony.
