Article 42.--CRIMES AGAINST THE PUBLIC SAFETY

      21-4232.   Unlawfully tampering with electronicmonitoring equipment.(a) Unlawfully tampering with electronic monitoringequipment isintentionally removing, disabling, altering, tampering with, damaging ordestroying any electronicmonitoringequipment used pursuant to court order or as a condition of parole.

      (b)   The provisions of this section shall not apply to:

      (1)   The owner of theequipment, or an agentof the owner, performing ordinary maintenance and repairs upon such equipment;or

      (2)   an employee of the department of corrections acting within suchemployee's scope of employment.

      (c)   Unlawfully tampering with electronic monitoring equipment is a severitylevel 6,nonperson felony.

      (d)   This section shall be a part of and supplemental to the Kansas criminalcode.
