Article 46.--SENTENCING

      21-4644.   Modification of sentence previouslydetermined under act; when.In the event the term of imprisonment for life without thepossibility of parole or any provisionof this act authorizing such term is held to be unconstitutional by the supremecourt of Kansas or the United States supreme court, the court havingjurisdiction over a person previously sentenced shall cause such person to bebrought before the court and shall modify the sentence to require no term ofimprisonment for life without the possibility of parole and shall sentence thedefendant to the maximum term of imprisonment otherwise provided bylaw.
