Chapter 23.--DOMESTIC RELATIONS
Article 4.--ENFORCEMENT OF SUPPORT

      23-4,145.   Reporting of support arrearages to consumer credit reportingagencies.(a) As used in this section, "consumer reporting agency" means any personwhich, for monetary fees or dues or on a cooperative nonprofit basis, regularlyengages in whole or in part in the practice of assembling or evaluatingconsumer credit information or other information on consumers for the purposeof furnishing consumer reports to third parties and which uses any means orfacility of interstate commerce for the purpose of preparing or furnishingconsumer reports.

      (b)   The secretary of social and rehabilitation services shall developprocedures for making information concerning support arrearages owed orassigned to the secretary or owed to any person who has applied forservices pursuant to K.S.A. 39-756 and amendments thereto available toconsumer reporting agencies upon their request. The procedures shallprovide for the information to be made available to such agencies in anycase in which the support arrearage is $1,000 or more unless the secretarydetermines that providing the information is not appropriate in aparticular case. The procedures may additionally provide for theinformation to be available to such agencies if the amount of the supportarrearage is less than $1,000.

      (c)   The secretary may charge a consumer reporting agency requestingsupport arrearage information a fee not to exceed the actual cost to thesecretary in providing such information.

      (d)   Prior to providing any information concerning an obligor's arrearageto a consumer reporting agency, the secretary shall provide advance noticeto the obligor who owes support by first-class mail to the obligor's lastknown address, concerning the proposed release of information to aconsumer reporting agency and of the methods available for contesting theaccuracy of the information as provided for in K.S.A. 50-710 and amendmentsthereto.
